STALLION BREEDING CONTRACT

I, ________________________________________________, hereby agree on this _________ day of _______________, _________, to breed the mare named below to, Heza Hero, (AQHA Registration # 3515982) between February 1st thru Ju= ly 2010 subject to the following conditions:

Except where purchased through an auction, the stallion fee is $750 and includes the 1^{st semen
collection and shipment of cooled semen payable upon execution of this
contract. The balance (if any) of the stallion fee shall be paid prior to
semen shipment or when the above mentioned mare is picked up from the
breeding facility (Equine Veterinary Services) if mare owner chooses to b=
ring
the mare to the clinic for AI. All other expenses, including chute fees, =
board
and unexpected veterinary expenses (if applicable) shall be paid monthly =
and
must be paid in full before the above mentioned mare is released.}

TCO Performance Horses, LLC / Equine Veterinary Serv= ices agree to provide suitable care and feeding for the mare and/or foal while at th= e breeding facility. All mares are grained twice daily and provided with adequate roughage from coastal hay and pasture turnout. The mare owner agrees to p= ay $15.00 per day dry or $18.00 per day wet. (Does not apply to shipped semen)=

TCO Performance Horses, LLC / Equine Veterinary Serv= ices will exercise judgment in the care and supervision of your mare. A veterinarian will administer medical care as deemed necessary for the hea= lth and safety of the mare. Mare owner hereby consents to all medical care administered to the mare by veterinarian as well as all Ferrier expenses.= (Does not ap= ply to shipped semen)

The mare shall be in healthy and sound breeding cond= ition: free from infections, contagious and transmittable disease. A current negative Coggins, a photo copy of registration papers (both sides), and a veterinarian’s health certificate are required. If mare owner should fail to provide any of these documents, ma= re owner consents to TCO Performance Horses, LLC / Equine Veterinary Services examining, testing and vaccinating mare as necessary at the mare owner’s expense. Stallion owner agrees to supply = a negative EVA to mare owner prior to mares’ arrival and with all semen shipme= nts. (Does not a= pply to shipped semen)

TCO Performance Horses, LLC / Equine Veterinary Serv= ices agree to diligently try to settle owner’s mare. Mare owner agrees to give= TCO Performance Horses, LLC / Equine Veterinary Services ample opportunity to settle the mare (having bred her through at least two heat cycles). (Does not ap= ply to shipped semen)

This contract contains a "LIVE FOAL GUARANTEE.&= quot; A live foal is described as a newborn foal, which stands and nurses witho= ut assistance. If the foal is born dead, return breeding privileges shall ap= ply only if TCO Performance Horses, LLC / Equine Veterinary Services is notif= ied within fourteen (14) days thereof and receives a veterinarian’s statement confirming death. Return breeding privileges apply only to the following breeding season. A substitute mare may be sent if the original = mare is deceased or deemed unfit for breeding. The "LIVE FOAL GUARANTEE&q= uot; in this contract is non-transferable and non-assignable without express written consent of TCO Performance Horses, LLC / Equine Veterinary Servic= es. Should the mare be sold or otherwise disposed of prior to the birth of the foal, the "LIVE FOAL GUARANTEE" may be void at the discretion o= f TCO Performance Horses, LLC / Equine Veterinary Services

A Breeders Certificate will be issued to the mare ow= ner when TCO Performance Horses, LLC / Equine Veterinary Services has been notified that a live foal has been produced= .

Neither TCO Performance Horses, = LLC / Equine Veterinary Services, Dr. Kenton H. Arnold (attending veterinarian)= , or employees or agents thereof, or the said stallion owner shall be liable for the death, sickness and/or accident to the mare and/or foal.

The parties acknowledge that this agreement is made = and shall be entirely performed within the State of Te= xas and shall be construed and enforced under the laws of the State of Texas.

Should the stallion die or become unfit for service = for any reason this contract shall become null and void and all parties are relieved from further obligation.
